Understanding Immigration Appeals in Canada

Immigration decisions can have a major impact on your life, your family, and your future in Canada. Fortunately, if your application has been refused or your immigration status is at risk, you may have the right to appeal. Knowing which appeals are available — and which are not — is the first step toward protecting your rights.

In Canada, most immigration appeals are handled by the Immigration Appeal Division (IAD) of the Immigration and Refugee Board (IRB). Here are the main types of appeals:

1. Sponsorship Appeals:

If you sponsored a family member (such as a spouse, common-law partner, child, or parent) and Immigration, Refugees and Citizenship Canada (IRCC) refused the application, you may be able to appeal to the IAD.

Example: A sponsorship is refused because the officer doubts the genuineness of a marriage. The sponsor may have the right to appeal.

2. Removal Order Appeals:

Permanent residents, certain foreign nationals, and protected persons may be able to appeal a removal order issued against them.

The IAD can consider not only the legal issues but also humanitarian and compassionate factors, such as your family ties in Canada, how long you’ve lived here, and the hardship you would face if removed.

Note: If you have a serious criminal conviction (generally with a sentence of six months or more), you may not have the right to appeal.

3. Residency Obligation Appeals:

To keep permanent resident status, you must spend at least 730 days in Canada within every 5-year period. If IRCC or the Canada Border Services Agency (CBSA) determines you have not met this requirement, you may lose your permanent resident status.

You can appeal this decision to the IAD, and the Board can consider humanitarian and compassionate reasons for why you were unable to stay in Canada.

4. Minister’s Appeals:

The Minister of Public Safety, through the CBSA, can appeal certain decisions made by the Immigration Division — for example, if someone was found not to be inadmissible. These cases are less common but are an important part of the appeal system.

What You Cannot Appeal:

Not all immigration decisions can be appealed. For example:
  • Refusals of temporary visas (such as visitor visas, study permits, or work permits).
  • Negative refugee decisions (these are reviewed by the Federal Court, not the IAD).

In these cases, the proper recourse may be an application for judicial review in the Federal Court.
